Didn't the FDA just redact 145 pages of myocarditis data that they were court ordered to publicly release? Same would have happened during your case discovery. Our government is getting away with murder.

The agency is "getting" away, but licensing board members are the ones who will be left holding the bag.

The FDA no doubt rests contentedly now that it has cleverly settled the case and forestalled discovery. However, there are now sundry licensing board members across the nation who just had the carpet yanked out from under them.

How would you like to be a board member right now and realize that the hammer you brought down on physicians--outside of your Board charter, mind you--is now without legal cause? Board members are probably calling attorneys right now.

I've never understood why plaintiffs would expect someone they're suing, someone they allege commited fraud and wrongdoing, would do anything other than deny the existence of incriminating material via discovery.

I guess if you know, and can prove, they have it, in you could catch them in a lie when they deny it. Maybe the judge will care?

Because astoundingly, some fair amount of time, they do produce the docs. This may be due to overlooking their importance, the lawyers are ethical, and/or production of docs was sloppy with no oversight.. I have been quite surprised by some disclosures.

Congratulations to you, the other plaintiffs and the attorneys on this “win” against corrupted big govt. We developed a nasal spray which inhibits adhesion of viruses and bacteria to the nasopharyngeal membranes. It is basically salt water, fulvic and soap! We have been using this formula for over 20 years after many articles have shown that biofilm bacteria are best dealt with by clearing the biofilms with nothing more toxic than soap! The only problem is it is cheap and effective! So after 20 yrs of use for chronic rhinosinusitis we distributed it immediately for patients with Covid since it also helped other upper respiratory viruses. Now the FDA has gone after us that we are promoting a product as a “cure” for Covid which we never did. We make the claim that it reduces the symptoms associated with bacterial and viral URI’s. I’ve had enough of dealing with these rogue agencies. They forced Amazon to pull the product. We continue to distribute it to patients with CRS. Our results of over 10,000 applications reveal NO side effects (as you’d expect), and the only criticism from less than 0.2% of patients is that it feels too strong and burns a bit. It reduces and eliminates crusting associated with chronic staph infections in the nose as well.

So much for our regulatory agencies….

Great, it is not new or even particularly innovative to prevent bacteria from proliferateing in

NP membranes. The virus story is a tag along fantasy. The real product development would be a suppository for Covidiocy. Where in the development process is that?

Chronic staph in nose ought to be easily treatable. Unfortunatley the person suffering

is doint the exact same things that cause the infection over and over.

Natural therapeutics rarely have adverse effects, easily mitigated.

I completely agree with Pierre that Senator Johnson should request and obtain the information that could have been discovered had the case proceeded. In this way, we benefit from both the capitulation of the FDA in their request and agreement to settle, and we also get the information from Weber Shandwick - the PR firm allegedly behind the horse dewormer propaganda ad campaign. Thank you, Pierre for all you do. And for your generous transparency on this issue. Of course, people are frustrated that the bastards might be getting away with something here. Our gov't avoided discovery, which is where a plaintiff gets to actually see "under the hood" a bit. Or, at least, that is the promise. As you say, under advice from Bowden Grey, your expert law firm, our (sic) government would have been able to not disclose their real actions and words. So let's raise a glass to you and your team!! You scored a limited, partial, and very meaningful victory. Good on you! And you shared your thought process and the team's process. And you showed us that Sen Johnson (along with others - Schmitt and Paul) are not unaware and they are looking at other ways to take back our deep administrative case.

I appreciate the background on the legal aspects. Amazing how the Government can just basically lie with immunity vis destruction of evidence or claiming false national security claims etc. Again there has been no consequences to the individuals who did this so they will do it again in the next planned pandemic and they will figure out how to shut down access to real facts with even more efficiency.

The government very often obscures discovery, and it takes big, big $ (and more) to cause enough hassle to the government to *maybe* get good discovery in a lawsuit. But good discovery has certainly been accomplished by litigators experienced in suing the government.

In this case, it sounds like the government would have dragged the suit on for many more years, and that the settlement we did get will be helpful in a couple of ways. Moreover, we have gained experience in litigating these type of suits, as well.

It sounds like Plaintiff doctors got roughly what they set out to get from the lawsuit,and that is indeed wonderful. It's easy for us to forget what they continue to do daily for us. I'm very happy for them.

One other aspect to consider: Most lawyers NEVER thought Boyden Gray would be successful... and Boyden proved them wrong (i.e. they suspected the FDA would drag it on for years or get a dismissal etc). So not only was it a win, but it was a surprise win

Yet the "victory" feels hollow and so very incomplete. Kudos, regardless; but it's time for these legal eagles to start thinking outside the box and outside of the parameters the matrix has provided as the "norm" -- just as "y'all" 😉 had to do. There has to be some other approach (constitutional) to be used. We can do better. Perhaps it requires not using the broken, captured, corrupt system to fix the broken, captured, corrupt system.

Dr Kory - it IS a victory.

No, we didn’t get them convicted for banning life-saving medicine & that’s VERY regrettable....but the FDA settling like this is a de facto admission of wrongdoing.

Whatever they may say, there’s no other real conclusion apart from this: they are withdrawing their LIES because they know they are indefensible.

This leaves the way open for accusations of murder / manslaughter.

One argument against them will be precisely this de facto admission that it was WRONG to withhold IVM. From there, the argument can be made that it was LETHAL.

You have done good work and should be PROUD!

The settlement is perfect; here’s why.

The FDA is corrupt, and even the lawyers involved still must circulate in the nasty aquarium that is the swampy DC/MajorMetro Axis Americana. They can only go “so far” and still be allowed to practice and socialize, etc. They pulled the sled as far as can realistically be expected. Fine.

The beauty now is that the FDA shield is vaporized and the little vermin that populate the US medical licensing boards are naked.

THOSE are the ones who shall pay dearly in the court of law going forward, because, really and truly, THEY were the tip of the spear that delivered the harm to the physicians around the nation.

The fear of a licensed physician is loss of income, whether it be lawsuit damages or loss of license. Ironically, fear of negative patient outcome was secondary, because physicians hewed to the FDA demands in the face of dying patients. So, let that stand for eternity as to how altruistic the medical profession’s members were/are. The walked the walk.

See the response posted in Kory’s first posting. It’s a high level map of how to till the landscape going forward and rid the soil of the vermin that infest it.

Never forget—never…it’s the man on the street who is communism’s most effective agent in securing control of the population and any particular segment within it. Always the little guy. When the little guys won’t or can’t do their little duties en masse, then the ruse fails. The board members are those little guys. And, individually, they go down like flies before lawsuits that are well thought out and justified by prior findings of fact or settlements in court.

Look at the high profiles examples like Merle Nass, Christine Northrup, Tenpeny, stateside, much worse in Chinada, Australia, Germany

Bankrupting a renegade and drawing out Board hearings, IDE tribunals, proceedings and hearings are the strategies. Usually closed to public scrutiny, difficult costly appeals.

The only difference is that Covidiocy has speed up public awareness a thousand percent. That is why people declare (as they should) that they well NEVER trust the Medical Professon again. Unfortunately the few honest docs are caught in the crossfire.

We have even better tricks in Australia with the Therapeutic Drugs Administration(TGA) that is paid for by big Pharma and gives Objective analysis for the public(Yeah right)

They have done their own secret analysis of the vaccines and refuse to release it due to Commercial confidentiality.

They have turned over 1000K deaths after/related? to the vaccine to less than 20 with criteria that is secret.

And if an FOI is used they can stall and claim the work is "ongoing" which means it cannot be FOI.

If anyone wants to test any medical product, Australia is perfect!!

TGA approves anything with no oversight..

And, the majority of the population is so docile, that they don`t care....
