I may be naive but it seems a simple, logical consideration.

There are two basic issues:

1) A trained, licensed physician, treating a patient who is uniquely different from all other patients, must be free to address and advise that patient to his best medical ability. Just as there is not one medicine or treatment that is universal so there is not one protocol that is universal.

2) There is the First Amendment right to free speech, and free speech does not allow speech that may cause harm. In this case the doctor was trying to prevent, what in his best medical expertise was harm to his patient, no cause it.

I add, the injunction against the persecution of this doctor was correct and should have happened long before now. It is a no brainer. The judge did not inhibit the remedy of mal practice suit open to any patient, so the patient is still protected.
